The H2B visa category is used by U.S. companies temporarily to employ skilled or unskilled workers in non-agricultural positions for which the employer has a temporary need and for which qualified U.S. workers are unavailable. Duration: maximum of one year but H2B visas may be extended for a maximum of three years in one-year increments. Upon reaching completion of the maximum stay a worker must depart the U.S. for at least six months.

CONDITIONS OF ADMISSIBILITY;
  • You must be a single worker or a group of workers and you identity must generally be known in advance, although substitution of names can occur in limited circumstances.
  • A Temporary Labor Certification (TLC) must be sought from Department of Labor before the US employer can hire a Canadian worker or a group of Canadian workers.
  • The US employer’s need for someone with your skills must be temporary.
  • The US employer must intent to employ you temporarily.
  • You can be skilled or unskilled.
  • You must intend to remain in the U.S. temporarily and must continue to maintain residence in Canada.
