The H2B visa category is used by U.S. companies temporarily to employ skilled or unskilled workers in non-agricultural positions for which the employer has a temporary need and for which qualified U.S. workers are unavailable. Duration: maximum of one year but H2B visas may be extended for a maximum of three years in one-year increments. Upon reaching completion of the maximum stay a worker must depart the U.S. for at least six months.
CONDITIONS OF ADMISSIBILITY;
You must be a single worker or a group of workers and you identity must generally be known in advance, although substitution of names can occur in limited circumstances.
A Temporary Labor Certification (TLC) must be sought from Department of Labor before the US employer can hire a Canadian worker or a group of Canadian workers.
The US employer’s need for someone with your skills must be temporary.
The US employer must intent to employ you temporarily.
You can be skilled or unskilled.
You must intend to remain in the U.S. temporarily and must continue to maintain residence in Canada.
