TN status is for Canadian and Mexican professionals working in USA. There is a limit of seven years on the amount of time a person can be in that status. TNs must have at least a baccalaureate degree or equivalent. Spouses and unmarried minor children accompanying or following to join a TN will get TD visas and are not authorized to accept employment. They may process their cases at the port of entry, and a Work Permit will be issued for one year with multiple entries.
Evidentiary Requirements:
- proof of nationality;
- a letter from the prospective employer;
- licenses (must have if required by profession);
- diplomas, degrees, certificates; or professional memberships.
The Petition must indicate:
- professional activity to be engaged in;
- purpose of entry;
- anticipated length of stay
- beneficiary's educational qualifications;
- beneficiary's compliance with applicable state law and arrangements for remuneration.
