H-1B Visa for International Professionals

Foreign workers in specialty occupations may be allowed entry into the US under the H-1B visa for International Professionals. With the H1-B visa, you may be allowed to stay in the United States for up to six years. Additionally, with this type of US visa, you have the option of immigrating to the United States if your US employer wishes to keep you for permanent employment. Your US employer may petition the government and you will be allowed to apply for US permanent residence (green card) if you wish to stay in the United States permanently. For international professionals in high skilled occupations, the H-1B visa could be the first step to obtaining permanent residence in the United States.

TN Visa for Professionals

The North American Free Trade Agreement (NAFTA) allows citizens from Canada and/or Mexico to work in the United States, and American citizens to work in Canada and/or Mexico, in certain professional occupations.  The Treaty National visa (TN) is temporary by design. It can be issued for up to three years and can be extended indefinitely from one to three years. To apply for the TN visa, you must meet the four basic conditions and also be able to prove that you have strong ties to Canada and the intent to return home after your work in the US is completed.

E-2 Investor Visa

The Treaty Investor visa (E-2) is a non-immigrant visa based on the 1989 treaty agreements between the US and Canada. The E-2 Investor visa is issued on the basis that the applicant is entering the US for the sole purpose of developing and managing a business in which they have a vested interest and intend to supervise their investment. To obtain an E-2 visa, you will need to have a minimum investment and meet the basic requirements. Your spouse and dependent children may also be granted E status which will allow children to attend school but will not allow them to work. However, your spouse may apply for a work authorization which will allow them to legally work in the US and obtain a US social security number.

Blanket L for Multinationals

The Blanket L is a special program for multinationals which allows them to transfer key employees to the US from any country in the world. With the Blanket L, the process of US immigration for foreign employees is made much easier and faster. With an 80% reduction in paperwork and reduced filing expenses, the Blanket L can save both time and money for multinationals. The duration of the Blanket L, once approved, is three (3) years after which you may submit a new petition to be approved indefinitely. L1-A and L1-B Work Visa

Foreign companies who are expanding their business into the United States are able to transfer their key employees from the foreign company into the US company. The foreign workers will receive an L1-A or L1-B work visa which will allow them to live and work in the US. While this work visa is temporary, it usually leads to permanent residence (green card) for most key employees who wish to immigrate to the United States. If you are a high-level employee – such as managers and executives – you are given “first preference” by US immigration for the purpose of obtaining permanent residence. Your spouse and children will also be able to obtain permanent residence if they choose to join you in the US. Additionally, spouses of L1-A and L1-B transferees are given US work authorization so that they may work legally in the United States and contribute to the advancement of their family. B-1 Temporary Business Visa

The B-1 Business visa is implicitly granted to all Canadians upon entry to the United States. Citizens of other countries, except for those countries under the visa-waiver program, will be required to apply for and obtain a visa. If you are a Canadian citizen or a citizen of one of the other qualifying countries, you may be able to obtain a B-1 Business visa at a Port of Entry. The B-1 Business visa is a temporary visa which can only be issued for a maximum period of one (1) year. Spouses and dependent children of B-1 Business visa holders are not allowed automatic entry and must apply for their own visa.

US Waiver for Inadmissibility

If you have been refused entry to the United States or you have reason to believe that you will be refused entry, you may still have the option of applying for a US Waiver of Inadmissibility. How do I apply for a US visa?

There are a number of options available for a foreign national to receive a US visa. You must find the program that best suits your situation and apply for your US visa under the specified visa program. There are some basic requirements which every person must meet in order to apply for a US visa. Select one of the following links to read some basic information and requirements for obtaining a US visa.

United States immigration law requires that all immigrant visa applicants receive vaccinations before they may obtain their immigrant visa. Medical examinations must be conducted by panel physicians. All immigrant visa applicants must have their vaccination records available to be reviewed by the panel physician at the time of their medical examination. You may be able to get a copy of your immunization record from your health care provider. If you cannot obtain a copy of your vaccination record, the panel physician may assist you in determining which of the vaccinations you need. You must have proof that you have received all of the following vaccinations (or that it is medically inappropriate for you to receive one or more of them):

  • Hepatitis A
  • Hepatitis B
  • Influenza
  • Influenza type b (Hib)
  • Measles
  • Meningococcal
  • Mumps
  • Pneumococcal
  • Pertussis
  • Polio
  • Rotavirus
  • Rubella
  • Tetanus and diphtheria toxoids
  • Varicella

Please note that all medical examinations must be given by a panel physician, a medical professional who is appointed by the U.S. Embassy or Consulate to provide examinations as required by the CDC and USCIS. Medical examinations given by overseas doctors who are not appointed by the local U.S. Consulate or Embassy will not be recognized for the purpose of immigration. You will be required to submit photographs with most US visa applications. If you did not submit your photographs as per the photograph requirements, you may take your photographs with you to your interview. You will need to provide two (2) identical color photographs which meet the size specifications and other requirements specified by the USCIS.
All visa applicants over the age of 16 are required to submit police certificates.

You must obtain police certificates from any country in which you have lived for over 6 months since the age of 16 or any country in which you have been arrested for any reason at any age. Each police certificate must cover the entire period of your residence, be issued by the appropriate police authority, and include all arrests along with the reason for each arrest and disposition of each recorded case.

Applications for US visas require a government application fee to be paid by the applicant. The amount of this application fee varies depending on the type of US visa for which you are applying. Immigrants to the United States will be required to undergo an interview prior to issuance of their US visa. You will receive notification that your interview has been scheduled and will need to be prepared with all of the necessary documentation. When you receive your notice, make sure to pay careful attention to the date, time and location of your immigrant visa interview.
